November Environmental Compliance Check-In: Prepare Your Facility for Year-End Reporting

As November begins and year-end approaches, operational demands invariably accelerate. Taking stock now of upcoming environmental reporting obligations can help facilities identify potential compliance gaps and prepare for the next reporting cycle.

This November environmental compliance check-in focuses on three major regulatory programs where late-fall preparation can make a significant difference: the Toxics Release Inventory (TRI), Toxic Substances Control Act (TSCA) PFAS reporting, and Emergency Planning and Community Right-to-Know Act (EPCRA) Tier II reporting.

While none carry an immediate November reporting deadline, each requires detailed data collection and technical analysis that can become increasingly difficult when deferred into the January rush.

1. TRI Reporting: Accelerate Reporting Year 2026 Data Compilation

Toxics Release Inventory (TRI) reports for reporting year 2026 must reach the U.S. Environmental Protection Agency (EPA) by July 1, 2027. Establishing defensible threshold determinations requires evaluating 12 months of operational records, raw material purchase receipts, and Safety Data Sheets (SDSs).

TRI Compliance Action Items to Review This Month

  • Standard Threshold Determinations: Revisit standard benchmarks, 25,000 pounds for chemicals manufactured or processed and 10,000 pounds for chemicals otherwise used, by auditing procurement logs, production tallies, and batch formulation sheets.
  • PFAS and De Minimis Elimination: More than 200 individual per- and polyfluoroalkyl substances (PFAS) are subject to TRI reporting requirements. Listed PFAS are classified as chemicals of special concern and generally carry a 100-pound reporting threshold per listed chemical or applicable category. They are ineligible for the de minimis exemption or simplified Form A filing. Materials containing even trace quantities must be considered when evaluating applicable reporting thresholds.
  • Supplier Notifications (40 CFR § 372.45): If your facility produces, packages, or distributes mixtures or trade-name products containing TRI-listed chemicals to other facilities, confirm whether required supplier notifications were issued or received this year.
  • Form A vs. Form R & PBT Chemicals: Identify whether any persistent, bioaccumulative, and toxic (PBT) constituents, such as lead, mercury, or polycyclic aromatic compounds, are present in your streams, as their substantially lower thresholds, often 10 to 100 pounds, dictate early tracking.

2. TSCA Section 8(a)(7) PFAS Reporting: Prepare for the Submission Window

EPA’s retrospective PFAS reporting rule under the Toxic Substances Control Act (TSCA) applies to entities that manufactured or imported PFAS, including PFAS present within imported articles, during any calendar year from 2011 through 2022, subject to applicable exemptions and final rulemaking.

Under EPA’s published schedule, the data submission window is scheduled to begin January 31, 2027, or 60 days following the effective date of finalized program amendments, whichever is earlier.

Given the depth of historical inquiry required, November provides an opportunity to finalize applicability reviews and organize supporting records before the reporting window opens.

TSCA PFAS Reporting Action Items to Review This Month

  • Article Exemption & Scope Monitoring: EPA has proposed revisions that would exempt certain article importers and modify other reporting requirements. However, proposed exemptions should not be treated as final requirements. Continue evaluating imported finished goods, mechanical subassemblies, and coated components that may contain fluorinated compounds while monitoring the status of the rulemaking.
  • Extensive Data Collection: Historical data requirements extend well beyond simple chemical names. They encompass specific structural identifiers, production and import volumes, end-use categories, process byproducts, environmental releases, worker exposure durations, and disposal pathways. Compiling these details across legacy suppliers often takes several months.
  • Central Data Exchange (CDX) Credentials: Confirm that your facility’s authorized representative holds an active CDX account with appropriate TSCA submission permissions and an updated Electronic Signature Agreement (ESA).

3. EPCRA Tier II Reporting: Prepare for the March 1 Deadline

Emergency Planning and Community Right-to-Know Act (EPCRA) Tier II chemical inventory reports for reporting year 2026 are due by March 1, 2027.

Because submission portals, local filing fees, and reporting requirements vary across state emergency response commissions (SERCs) and local emergency planning committees (LEPCs), early reconciliation can help facilities avoid last-minute bottlenecks.

EPCRA Tier II Compliance Action Items to Review This Month

  • Inventory & SDS Reconciliation: Match your current on-site physical bulk inventory, cylinders, and warehouse drums against your active chemical register and SDS library now, rather than waiting until February.
  • Threshold & EHS Evaluations: Apply the baseline 10,000-pound reporting threshold for standard OSHA-hazardous chemicals and evaluate the applicable Threshold Planning Quantities (TPQs) for listed Extremely Hazardous Substances (EHS), including chemicals such as chlorine, ammonia, and sulfuric acid.
  • Facility Modifications & Portal Access: Verify that building changes, storage relocations, or new chemical additions introduced throughout 2026 are properly mapped. Ensure your facility’s access credentials for state-specific reporting software, such as Tier II Submit, E-Plan, or dedicated state portals, are operational and updated.

Why Early Environmental Compliance Preparation Matters

Each of these three regulatory frameworks requires labor-intensive technical analysis:

  • TRI: Compiling 12 months of throughput data and supporting threshold calculations.
  • TSCA PFAS: Conducting multi-year retrospective supply chain research.
  • EPCRA Tier II: Reconciling chemical inventories, storage locations, and reporting thresholds.

Starting these workflows in November allows facilities to identify and address data gaps before year-end operational cutoffs, financial closes, and holiday staffing shortages create additional pressure.

Proactive environmental compliance planning can also help facilities maintain more complete records, support accurate reporting, and reduce the risk of errors during the upcoming reporting cycle.

How EDGE Can Help

EDGE Engineering & Science provides technical support across each of these environmental compliance disciplines:

  • TRI Reporting: Threshold calculations, mass-balance release determinations, supplier notification audits, Form R/Form A compilation, and CDX uploads.
  • TSCA PFAS Reporting: Retrospective applicability determinations, supply chain scoping, historical records reconciliation, and portal submission QA/QC.
  • EPCRA Tier II Reporting: Physical inventory reconciliation, mixture component calculations, site map updating, and electronic submission across state-specific portals.

Establishing that your facility falls below reporting thresholds provides the same compliance value as submitting a complete filing.

If any of these programs intersect with your facility’s ongoing operations, contact EDGE Engineering & Science to schedule an initial scoping conversation. Our team can assess your process flows and outline an efficient strategy for the upcoming reporting cycle.
