EPA Extends 2024 TSCA Chemical Data Reporting Deadline Due to Technical Issue with CBI Substantiation Tool

On September 20, 2024, the U.S. Environmental Protection Agency (EPA) announced that it is extending the deadline for the 2024 Toxic Substances Control Act (TSCA) Chemical Data Reporting (CDR) submissions to November 22, 2024. This extension applies only to the 2024 reporting cycle, with future submission periods remaining unaffected.

The EPA is taking this action due to a technical issue discovered in the CDR data submission tool. Specifically, the tool has had trouble correctly capturing substantiations for Confidential Business Information (CBI) claims related to chemical identities. When submitters used the tool to copy substantiations from one chemical identity to another, not all questions and responses were properly carried over. This issue, though affecting only a small percentage of submitters making CBI claims, is critical because ensuring the proper substantiation of these claims is required by TSCA regulations (40 CFR 711.30). As a result, EPA has extended the submission deadline to give submitters sufficient time to review and update their CBI claims and substantiations and to allow EPA time to fully resolve the issue.

The EPA has already taken steps to address the problem and expects to have the tool functioning correctly before the end of September 2024. In the meantime, submitters are advised to avoid using the copy functionality within the tool for chemical identity CBI claims.
